In the Supreme Court hearing today, the University Grants Commission(UGC) had issued an affidavit against the Maharashtra government’s decision to cancel the final year examinations slated to held this year. The UGC. Education Officer, Dr. Nikhil Kumar, stated that the Maharashtra and Delhi government’s decision not to conduct the last year/ semester examinations is baseless and contradictory to the UGC guidelines. They also contended that such choices could jeopardize the career of the students and is not in their interests.
The UGC is responsible for maintaining the standards of higher education in the country, which, as per their claims, could fall apart if the examinations of final year University students get canceled. Moreover, the autonomous body asserted, since the University Grants Commission is bound to regulate the standards of higher education in the country, such a decision would raise a serious question upon their functioning and administration. The Board members of the commission also asserted that it could prevent the commencement of the successive academic session too, which can sabotage the future of students, and thus is meritless.
It had stipulated in its affidavit that the final semester examinations must take place, after duly assessing and evaluating the prevailing Covid-19 situation. They strongly urged the benches that the Maharashtra and Delhi must conduct the tests as it is critical to the student’s academic and career interests. The UGC had earlier published the guidelines as on April 29, 2020, with all the legislative statutory bodies, that all the higher educational institutions must conduct final year/last semester examinations in July 2020, keeping in line with their safety and health issues. However, owing to the rising COVID-19 cases, the body, in its revised guidelines as on 06.07.2020, re-emphasized upon the need to conduct final year examinations, as it is incredibly crucial for the academic and career interests of its students.
The UGC. also stated very explicitly that only the Parliament reserves all the right to make decisions about the academic interest under Entry 66 of List I of Schedule VI of the Constitution. Hence, UGC. Guidelines bind all the universities of higher education to abide by it.
Another primary concern is the possibility of the ‘Disaster Management Act’ overriding the provisions of UGC. Guidelines in a health-related crisis like this. This issue came into light when the Maharashtra government passed a resolution on June 19 to cancel the final year examination based on the decision taken by the State Disaster Management Authority( SDMA).
On Friday, the case will be carried forward for further proceedings.
